Collective Bargaining Agreement

Also known as the "CBA," or "Contract," the Collective Bargaining Agreement is a negotiated agreement between the union and the state.  Each side has equal input. It applies to all classified state employees and includes wages, benefits, and working conditions.  It also includes a number of agency-specific "sub-unit" agreements which are additional negotiated agreements which apply to employees of those agencies.

When an employee believes that management has violated the terms of the CBA, they have the ability to file a grievance.  Obviously, some situations are valid grievances and others are not.  The first step in pursuing any grievance is to contact your union steward.

The union represents members in contract grievances.   Non-members (Agency Fee payers) are also represented by the union in contract grievances.

The Administrative Rules of the NH Division of Personnel are not a negotiated agreement between the union and the state.  They are a set of rules developed by management, although the union can sometimes be successful in influencing the contents.  The Personnel Rules apply to all classified state employees and include such things as discipline, layoff, classification, promotion, selection, and evaluation.

When an employee believes that management has violated the Personnel Rules, they have the ability to file a request for dispute settlement, or an "appeal."  Obviously, some situations are valid appeals and others are not.  The first step in pursuing any appeal is to contact your union steward.

The union represents only members in Personnel Rule appeals, as a benefit of membership.
